Is it legal for unmarried couples to stay in hotels in India?
The answer is yes.
If two consenting adults having valid ID proofs, choose to stay in a hotel room, there can be no restrictions levied on them. There is no law which prohibits unmarried couples to stay in a hotel room.
Still in various instances, police harass young couples in hotel rooms by dragging them out and detaining them for hours.
The couple-friendly hotels encounter a multitude of obstacles because of the social stigma attached to pre-marital sex.
In June 2019, a lodge affiliated to OYO Rooms in Coimbatore, which permitted unmarried couples to board their rooms, was sealed on the orders of the Collector and a couple who had rented one of the rooms, was secured and taken to Police Station.
The action against the lodge was initiated on a complaint received from AIDWA (All India Democratic Women’s Association).
The lodge had advertised itself as a safe place for unmarried couples. As per the association, this action of the lodge was illegal and against Indian culture and tradition.
The aggrieved Petitioner filed a Writ Petition before the Madras High Court.
